The SOLAS System is offered by GEMINI as a free service and is provided “as is” and on an “as available basis” without any representations or warranties, express or implied. By using the SOLAS System whether to transmit and/or receive information or data, the users assumes all risks associated with the use of the SOLAS System. By way of example only and without providing an exhaustive list, those risks may include a failure to transmit, transmission errors, data breaches, security breaches and the transmission of viruses. Neither Gemini nor any of its employees, officers, directors, representatives and affiliates (collectively “Gemini”) shall be deemed to have made any representations or warranties, express or implied as to the content, accuracy, completeness, suitability, error free content, uninterrupted service or the timeliness of the information or data received and/or transmitted by the SOLAS System. Nor shall Gemini have any liability to you, your representative or any other person or entity resulting from the use of the SOLAS System or the information transmitted thereby.
